Terms of Service

1. Agreement to Terms

By accessing or using the Smashr platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Smashr is a cloud-based club management platform that helps sports clubs manage students, members, scheduling, billing, and communications. The Service is provided on a subscription basis with various plan tiers.

3. Account Registration

To use the Service, you must create an organization account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must provide accurate and complete information during registration.

4. Subscription and Billing

Paid plans are billed on a monthly or yearly basis. All fees are non-refundable unless otherwise stated. We may change pricing with 30 days' notice. If payment fails, we may suspend or restrict access to your account.

5. Free Trial

New organizations receive a 14-day free trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service. Data is retained for 30 days after trial expiry.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other accounts or systems
  • Upload malicious content or interfere with the Service
  • Resell or redistribute the Service without authorization
  • Violate any applicable laws or regulations

7. Data Ownership

You retain ownership of all data you upload to the Service. We do not claim any intellectual property rights over your content. You grant us a limited license to host and process your data solely for the purpose of providing the Service.

8. Data Protection

We process personal data in accordance with our Privacy Policy. You are responsible for ensuring that you have appropriate consent to upload personal data of your club members and students.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for any downtime or service interruptions.

10. Termination

You may cancel your subscription at any time. We may terminate or suspend your account for violation of these Terms. Upon termination, you may request export of your data within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, Smashr shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
